Terms of Service

These Terms of Service govern your access to and use of the Plasmatic website. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About us

The Site is operated by Plasmatic Solutions Pte. Ltd. (“Plasmatic”, “we”, “our”, or “us”), a private limited company incorporated in Singapore with UEN 202602426M, having its registered office at 60 PAYA LEBAR ROAD, #06-28, PAYA LEBAR SQUARE, SINGAPORE 409051.

2. Definitions

• “Site” means the Plasmatic website at goplasmatic.io and any related subdomains.
• “Content” means all text, images, graphics, code, designs, logos, marks, audio, video, and other materials made available through the Site.
• “User”, “you”, and “your” refer to any individual or entity accessing or using the Site.

3. Use of the Site

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Site for your personal or internal business purposes. This licence does not include the right to resell, redistribute, or commercially exploit the Site or its Content.

4. Intellectual property

All Content on the Site, including the Plasmatic name, logo, product names, design, and underlying code, is owned by or licensed to Plasmatic and is protected by Singapore and international intellectual property laws.

Open-source components used on the Site or in our products remain governed by their respective licences. Use of those components is subject to those licences in addition to these Terms.

Except as expressly permitted, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works of any part of the Site without our prior written consent.

5. User submissions

Where you submit information through the Site (for example, via the contact form), you represent and warrant that you have the right to do so and that the information is accurate and not unlawful. You grant Plasmatic a worldwide, royalty-free, non-exclusive licence to use, reproduce, process, and store the information for the purposes of operating and improving our services and responding to you.

6. Acceptable use

You agree not to:

• Use the Site in violation of any applicable law, including the Computer Misuse Act 1993 of Singapore.
• Interfere with or disrupt the Site, its servers, or networks, or attempt to bypass any security or authentication measures.
• Access, scrape, or harvest data from the Site through automated means without our prior written consent.
• Upload or transmit viruses, malware, or other malicious code.
• Use the Site to send unsolicited communications in violation of the Spam Control Act 2007 of Singapore.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We are not responsible for the content, policies, or practices of any third-party websites or services. Your use of such third-party offerings is at your own risk and subject to their respective terms.

To the maximum extent permitted by law, Plasmatic disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.

Information on the Site is provided for general informational purposes only and does not constitute professional advice. You should not rely on the Content as the sole basis for any decision.

9. Limitation of liability

To the maximum extent permitted by Singapore law, in no event shall Plasmatic, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, business opportunity, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Site.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms or the Site shall not exceed Singapore Dollars one hundred (S$100). Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

10. Indemnity

You agree to indemnify and hold harmless Plasmatic and its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms or your misuse of the Site.

11. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including if we reasonably believe you have breached these Terms. Sections that by their nature should survive termination will survive, including provisions on intellectual property, disclaimers, limitation of liability, indemnity, and governing law.

12. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

13. Changes to these Terms

We may revise these Terms from time to time. The most current version will always be posted on this page. By continuing to use the Site after changes take effect, you agree to be bound by the revised Terms.

14. Governing law and jurisdiction

These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter or formation shall be governed by and construed in accordance with the laws of the Republic of Singapore.

The Singapore courts shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Site.

15. Severability and waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be deemed a waiver of such right or provision.

16. Entire agreement

These Terms, together with the Privacy Policy and any other notices we publish on the Site, constitute the entire agreement between you and Plasmatic regarding your use of the Site and supersede any prior agreements on the same subject.
